Prohibition of Monopolistic Practices and Unfair Business Competition in Indonesia: A Legal Mechanism to Balance the Public Interest

The study is to explore the legal mechanism of prohibition monopolistic practices and unfair business competition in Indonesia by looking at role Business Competition Supervisory Commission (KPPU). This was conducted using empirical normative method. In this context, regulatory reference used Law No. 5 1999 (Anti-Monopoly Law). Other regulations are Article 34 Presidential Decree 75 named Several KPPU decisions analyzed were cities Medan, Semarang, Surabaya, Makassar Central Jakarta. results showed that regarding Prohibition Monopolistic Practices Unfair formulated principle balancing interests, namely balance between interests actors with public interest. formulation can be found considerations, explanations articles 1999.
